DAKUTX | Returns & Exchanges Policy

1.Purpose and application:
DAKUTX operates a commerce and manufacturing platform connecting independent brands, designers, creators and businesses with production and fulfilment services.
This policy explains the general returns, exchanges and consumer protection framework applicable to products purchased through DAKUTX and its associated vendor storefronts.
All participating vendor storefronts operate under a standardised retail Returns & Exchanges Policy, which provides further information about the process applicable to customer orders.

2. Legal seller and responsibility:
The legal seller responsible for each purchase is the contracting entity identified in the customer's transaction documentation. Depending on the transaction structure, this may be Danou Pty Ltd, operating DAKUTX, or another identified seller. Where Danou Pty Ltd is the legal seller, it retains responsibility for the obligations imposed on it by applicable consumer law. Where another entity is the legal seller, that entity retains its applicable statutory obligations. DAKUTX may administer customer enquiries, returns and remedies on its behalf. Nothing in this policy transfers, excludes or limits any statutory responsibility that DAKUTX, a vendor or another participating entity may have under applicable law.

3. Change-of-mind returns and exchanges:
DAKUTX supports made-to-order, customised, standard-size and other product categories. Except where required by applicable law, products purchased through participating vendor storefronts are not eligible for change-of-mind returns, refunds or exchanges. This includes requests arising solely from a change in personal preference, an incorrect size selected by the customer or a decision that the product is no longer required.
Any discretionary exception must be expressly confirmed by the responsible seller.
These commercial restrictions do not affect any mandatory consumer rights.

4. Australian Consumer Law:
Where the Australian Consumer Law applies, customers benefit from statutory consumer guarantees that cannot be excluded, restricted or modified by this policy.
Depending on the circumstances, these guarantees include requirements that goods be of acceptable quality, match their description and any applicable sample, and be reasonably fit for a disclosed purpose where the relevant guarantee applies.
Applicable services must also satisfy relevant statutory guarantees, including due care and skill.
Made-to-order, customised, discounted and final-sale descriptions do not remove these statutory protections.

5. Faulty, defective or incorrectly supplied products:
Customers who believe their purchase fails to meet an applicable consumer guarantee may request an assessment and any remedy to which they are legally entitled.
Relevant issues may include manufacturing defects, unsafe products, materially incorrect specifications, incorrect items or products that do not conform to applicable statutory guarantees. Where a product has a major failure under the Australian Consumer Law, the customer may generally choose between a refund and replacement of the same type, or pursue another available statutory remedy. For a minor failure, the responsible seller may initially provide an appropriate remedy, such as a repair, within a reasonable time.
If the issue cannot be resolved within a reasonable time, the customer may become entitled to further statutory remedies. Depending on the circumstances, customers may also have rights to compensation for reasonably foreseeable loss or damage.

6. Made-to-order products, measurements and fit:
Products manufactured to customer-supplied measurements, selected sizes or approved specifications are subject to the same applicable statutory consumer guarantees as other eligible goods. Where a product has been correctly manufactured and supplied in accordance with the agreed specifications, a subsequent change in personal fit preference does not, by itself, create an entitlement to a refund or exchange.
A request for a discretionary alteration or remake may be considered separately and may attract an additional agreed charge.
Where incorrect fit or measurements arise from a manufacturing error, an inaccurate description, a failure to meet agreed specifications or another applicable consumer guarantee failure, statutory rights remain unaffected.

7. Assessment and return arrangements:
DAKUTX provides a central customer support contact for enquiries relating to participating vendor storefronts.
Customers may be asked to provide reasonable information, including proof of purchase, a description of the issue and relevant photographs, where appropriate.
The responsible seller may reasonably inspect a product or arrange an assessment before determining the appropriate remedy. This process must not unlawfully delay or prevent the exercise of statutory rights. The absence of original packaging does not invalidate an otherwise legitimate claim under the Australian Consumer Law.

8. Return transport and associated costs:
Return arrangements and associated costs will be determined in accordance with applicable law and the circumstances of the claim. Where a product is found to have failed an applicable consumer guarantee, reasonable return costs incurred by the customer will be reimbursed where required by law. Where goods cannot reasonably be returned because of their size, weight or other relevant circumstances, the responsible seller will arrange collection or otherwise meet its applicable statutory obligations.

9. Refunds, replacements and repairs:
Where a refund is required under applicable law, it will be provided in accordance with the customer's statutory entitlements, generally through the original payment method unless another method is agreed. A customer will not be required to accept store credit in place of a refund to which they are legally entitled. Repairs, replacements, refunds and any applicable compensation will be administered in accordance with the responsibilities of the legal seller and the applicable law.

10. International purchases:
DAKUTX and participating vendors may accept orders from customers outside Australia.
The rights and remedies applicable to an international purchase depend on the relevant transaction and applicable law. Nothing in this policy is intended to exclude, restrict or modify any mandatory consumer protection that applies to an international customer's purchase.

Please include the order number, relevant vendor or brand name, a description of the issue and supporting information where appropriate. DAKUTX will administer the enquiry or refer it to the responsible seller, as appropriate, without removing any responsibility imposed on DAKUTX by law.

12. Preservation of statutory rights:
Nothing in this policy, a vendor policy, a product description, an order confirmation or any other commercial term excludes, restricts or modifies any consumer guarantee, right or remedy to the extent that doing so is prohibited by applicable law.
Where this policy is inconsistent with a mandatory legal requirement, that requirement prevails.
